Membership Terms & Conditions

These Terms and Conditions (“Terms”) govern all memberships (“Memberships”) offered by Mountain Club Queenstown Limited (NZBN 9429047330467) (“Mountain Club”, “we”, “us”, “our”). By joining or renewing a Membership, you agree to be bound by these Terms.
Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other applicable New Zealand legislation that cannot be excluded by agreement.
Global Access is available as an add-on to Core Membership and includes all Core Membership benefits, plus:
Access to facilities may occasionally be limited due to private venue bookings or capacity constraints. We will provide reasonable notice whenever possible.
You may cancel your Membership within 30 days of joining for any reason. A cancellation fee of $50 + GST will apply to cover administrative costs. Any remaining balance paid will be refunded within 14 business days.
After the 30-day cooling-off period, Memberships cannot be cancelled during the current 12-month term. If you are on a monthly payment plan and wish to discontinue your Membership, you are required to pay the remaining balance for the current 12-month commitment in full.
To prevent automatic renewal, you must provide written cancellation notice at least 14 days before the end of your current 12-month term. Cancellation notices received after this deadline will take effect at the end of the following Renewal Term.
All cancellation requests must be submitted in writing to membership@mountainclub.co.nz. Verbal cancellation requests will not be accepted.
Memberships cannot be paused, suspended, or deferred for travel, injury, or any other reason.
Membership fees are payable either automatically via the Optix platform or by invoice, as selected by the member at the time of joining.
For security purposes, Mountain Club requires a valid credit or debit card to be held on file for all members, regardless of payment method. By providing your card details, you authorise Mountain Club to securely store and use your card for recurring membership fees and any overdue amounts in accordance with these Terms.
If an invoice remains unpaid after the due date, Mountain Club will send reminder emails on the 10th and 20th of the month.
If payment has not been received by the 20th of the month, a late fee of $150 + GST will be applied to the outstanding invoice. This late fee will continue to accrue on the 20th of each subsequent month until the balance is paid in full.
If payment remains outstanding after reasonable notice, we will automatically charge the card on file for the full outstanding balance. By maintaining your Membership, you consent to this payment process.
Memberships are non-transferable. In rare and exceptional circumstances, Mountain Club may approve a transfer at its sole discretion.
Membership at Mountain Club is a privilege that comes with a shared responsibility to uphold the respectful, inclusive, and community-minded values of the Club. All members and their guests are expected to:
Mountain Club reserves the right, acting reasonably, to suspend or terminate a Membership without refund where a member’s conduct or presence is found to be disrespectful, harmful to others, or detrimental to the wellbeing or enjoyment of the Club community. Where practicable, Mountain Club will provide the member with notice and an opportunity to respond before taking such action.
By attending Mountain Club events or using our spaces, you consent to the reasonable use of your image, name, or likeness in Club communications, photography, and promotional materials. If you do not wish to be photographed or featured, please notify a staff member at the time.
You acknowledge that use of Mountain Club premises and participation in events is at your own risk. To the fullest extent permitted by law, Mountain Club and its directors, staff, and affiliates (together, “Mountain Club Parties”) are not liable for any loss, injury, damage, theft, or destruction of property occurring at or in connection with Mountain Club premises or events, except where caused by our gross negligence or wilful misconduct.
The total liability of Mountain Club Parties to any member, guest, or invitee for any and all causes of action will not exceed the total Membership fees paid by that member in the twelve (12) months preceding the claim.
Where a Membership is acquired for business purposes, you agree that the Consumer Guarantees Act 1993 does not apply to the extent permitted by law.
Members agree to indemnify and hold harmless Mountain Club Parties from and against any loss, liability, claim, cost, or expense (including reasonable legal fees) arising from:
This indemnity survives termination of Membership.
Use of Mountain Club’s Wi-Fi network, printers, digital systems, or any technology services is at your own risk. Mountain Club is not responsible for any loss of data, hardware damage, connectivity issues, or other technical faults arising from the use of these services. Members should take appropriate security precautions when connecting personal or business devices to the Club network.
Mountain Club will not be liable for any delay, suspension, or failure to perform its obligations under these Terms due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, government restrictions, acts of terrorism, strikes, failure of utilities, or loss of access to premises. In such circumstances, Mountain Club’s obligations are suspended for the duration of the event, and no refunds or compensation are payable.
For the safety and security of members, certain areas of Mountain Club premises may be monitored by CCTV or other surveillance systems. Recordings are handled in accordance with the Privacy Act 2020 and are used only for security, operational, or legal purposes. By entering Mountain Club premises, members consent to this reasonable monitoring.

Members may not use the name “Mountain Club”, our logos, images of our venues, or likenesses of other members without prior written consent. Members must not copy, distribute, or use any materials, names, or intellectual property of other members or guests for commercial or promotional purposes.
Members must respect the privacy and confidentiality of other members and Mountain Club. Information learned through Club membership, events, or the member community—whether personal, professional, or business-related—must not be disclosed, reproduced, or used for commercial or personal gain without the consent of the person or entity to whom it relates.
This obligation continues after a Membership ends.
Membership provides a licence to use Mountain Club facilities and services in accordance with these Terms. It does not grant any tenancy, leasehold, or other real-property interest under the Residential Tenancies Act 1986 or otherwise. All premises remain under the possession and control of Mountain Club at all times.
We may update these Terms from time to time. Material changes will be notified to members via email and will be posted on our website. Changes take effect from the date specified in the notice. Continued use of your Membership after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the courts of Otago, New Zealand.
